In the following terms and conditions “The Photographers” shall mean Florence & Charles Cannon-Audley. “The Client” shall be those persons defined as bride and groom, bride and bride or groom and groom. It is mutually agreed that the following terms of agreement form an integral part of this contract and that no variation or modification of this contract shall be effective unless accepted by both the Photographers and the Client, in writing.

1. SUMMARY
The Photographers are responsible for providing the Client a photographic service.

2. DELIVERY

Imagery selected by the Photographers to be supplied within eight weeks of the wedding date with all images in high resolution plus uploaded onto a private online viewing gallery.

If 1 x photographer is booked to shoot the number of photos delivered will typically be in the region of 350<450.

If 2 x photographers are booked the number of photos delivered will typically be in the region of 550<650.

Highlights videos vary depending on the brief, however a standard video typically runs for between 4.5 and 7 minutes. Speeches are included, recorded and delivered separately at no extra cost. Ceremonies can be recorded at an additional cost of £200.



3. PAYMENT ARRANGEMENTS

The Client will pay the photographers a total fee according to agreed quote and with the following payment terms: 

BOOKING FEE: A booking fee of 50% of the agreed fee will confirm and reserve the date.

BALANCE PAYMENT: The balance is to be made not later than 30 days prior to the wedding day. Payment for additional products including albums, photographs, prints and frames is made after the wedding at the time of order. Prices of albums and other products may fluctuate from price on booking.


4. CANCELLATION

If the Photographers have to cancel for reasons beyond their control, (death, injury, sickness, etc.), their liability shall be limited to a full refund of all monies paid. Every effort will be made to find an alternative, qualified photographer(s).

Should the client cancel, as compensation for loss of income for the Photographers, the following charges apply as a percentage of the total fee due.

Number of days before the wedding:

60 days or fewer -100% / 61-90 days - 75% / 91-120 days - 50% / 120 + days - 25%

Should the cancelled wedding turn out to be a postponement, then, subject to the Photographers’ availability, all money paid maybe applied to the new wedding date. In this case, the total fees chargeable shall be the fee, which applies at that time. In the event of the Photographers taking another wedding booking for your cancelled or postponed a refund of your deposit (less expenses) and monies paid shall be made.


5. WEDDING ARRANGEMENT & COMMUNICATIONS

Where possible an in-person pre-wedding consultation will result in a rough overview of the day and the Photographers will have the opportunity to advise on planning, logistics and timings required. The Photographers will reconfirm all details via email before the wedding. The Client will confirm the accuracy of all timings and venues and advise on any changes in writing. Any special requests with regards to specific desired imagery must be confirmed in writing by the client ahead of the wedding.

THE SCHEDULE: A schedule will be agreed upon in advance of the wedding date and the Client will agree that punctuality and adherence to the agreed schedule will result in great photography. The Photographers will endeavour to compensate where possible when changes occur, such as extreme delays to start of ceremony, but cannot guarantee that the usual set of images will be produced when under this sort of time constraint as time changes may affect creative factors such as available light.

HOUSE RULES: On occasion the Photographers may be limited by rules imposed by registrars, ministers and venue management as to usage of flash, access and general movements within venues. In such circumstances the Client agrees to accept the technical limitations that may be imposed. The Photographers recommend that such restrictions be discussed in advance and where possible limitations be negotiated.


6. CREATIVE LICENCE

The Photographers shall be granted creative and artistic license in relation to the choice of locations and poses used. The Photographers’ judgment on photographic style and the number of photographs taken shall be deemed correct. Due to changes of the weather, available natural light, the availability and willingness of subjects and restrictions of officials, the Photographers will do their best to honour requested photographs but do not undertake to guarantee any specific picture nor incorporate any specific background, location or group arrangement.

The photographers will make the final selection of images to be delivered and will edit and post- produce the images according to their style. There is no right to reject the images on the basis of style or composition.


7. COPYRIGHT & BUYOUT

The 1998 Copyright, Designs, and Patents Act assigns copyright to the Photographers. Copies may be made from the files provided for private use only and must not be used for advertising or public display unless agreed with the Photographers beforehand. The photographers may use images taken to generally promote the business in advertising, magazine articles, websites, social media and sample albums unless prior agreement is made otherwise.

Where images are shared with other suppliers, it must be stipulated that images must not be used without crediting Florence & Charles with appropriate links according to the media channel.

If the client wishes to have exclusive use of their images, meaning the photographers cannot use them for any form of promotion whatsoever, including on their media channels and website, a buyout fee of 50% of the shoot cost will be added to the final invoice. 

If The Client wishes to use the images to promote their own professional endeavours a buyout fee of 50% of the shoot cost will be added to the final invoice.


8. EXCLUSIVITY & COOPERATION

The Photographers will be the sole professional photographers and videographers at the venues specified. We do however positively encourage family, friends, and other guests to take photographs throughout the day but respectfully request that the bride and groom agree to give the Photographers precedence over guests in order to deliver the photography services agreed. This may include requesting guests not to use mobile phones at key points throughout the day, as they may obscure or crowd the photographers’ line of sight. 

 The Client/s consent to cooperate and communicate with the Photographers in order to ensure that the Photographers have sufficient warning of key events, provided information requested about key group photos required and appoint a suitable member of the wedding party to assist in coordinating such events. Please note that sometimes guests prefer not to be photographed and therefore the Photographers will use their discretion but cannot be held responsible for a lack of photos of such people.


9. LIMIT OF LIABILITY

The Photographers take every precaution to prevent the loss or damage to your images. However, there is the unlikely possibility that images may be lost, stolen or destroyed for reasons in or beyond our control. In these circumstances liability is limited to the return of fees paid for the service or part thereof according to the percentage of images supplied. The Photographers carry full Public Liability Insurance, copies of which can be made available upon request.



10. CATERING

The client will provide a full hot meal for the Photographer(s) to be taken at the same times as the client and guests where hours worked are more than 5.  Where this cannot be supplied the Photographer(s) reserve the right to leave site for one hour to seek alternative arrangements.  


11. PRIVACY

The Photographers will store your name and wedding details on a private internal database. These details will not be made available to companies or individuals outside of Florence & Charles. Should you wish to have your details removed from our database, please advise in writing.
